By accessing or using JPK TimeClock ("JPK TimeClock" or "the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. The Service is operated by Kilbourne.JP, LLC d/b/a JPK Collision Solutions ("Company," "we," "us," or "our").
JPK TimeClock is a cloud-based time and attendance tracking software designed for businesses to: Track employee clock-in/clock-out times, monitor attendance and tardiness, generate time and attendance reports, and manage employee schedules and locations.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials, all activities that occur under your account, and notifying us immediately of any unauthorized use.
JPK TimeClock is offered at an annual subscription rate that is currently $400/yr with a discount to $300/yr for founding members.
AUTOMATIC RENEWAL NOTICE: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AT THE END OF EACH SUBSCRIPTION PERIOD UNLESS YOU CANCEL. You will be charged the then-current renewal price using the payment method on file. We will send a reminder email at least 30 days before your renewal date.
How to Cancel: You may cancel your subscription at any time by: (a) logging into your account and selecting "Cancel Subscription" in Settings, (b) emailing jpk@jpkauto.com with the subject "Cancel Subscription," or (c) calling during business hours.
You agree to use the JPK TimeClock only for its intended purpose of tracking employee time and attendance in compliance with all applicable laws. You may not use the JPK TimeClock to: Falsify, manipulate, or fraudulently alter time and attendance records; Violate any applicable wage and hour laws, labor laws, or employment regulations; Engage in any form of employee surveillance beyond time and attendance tracking; Attempt to gain unauthorized access to other customers' data or systems; Reverse engineer, decompile, or attempt to derive the source code of the JPK TimeClock; Resell, sublicense, or transfer access to the JPK TimeClock to third parties.
You retain ownership of all data you input into the Service. You grant us a license to use your data solely to provide the Service. Upon termination, you may request export of your data within 60 days. We may retain anonymized/aggregated data for analytics or metrics.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
IN NO EVENT SHALL KILBOURNE.JP, LLC D/B/A JPK COLLISION SOLUTIONS BE LIABLE FOR: Any indirect, incidental, special, or consequential damages; loss of profits, data, or business opportunities; damages exceeding the amount paid for the Service in the 12 months prior to the claim.
YOU ACKNOWLEDGE THAT: Time records should be verified by employer before processing payroll; the Service is a tool to assist with time tracking, not a guarantee of accuracy; technical issues may occasionally affect availability; you are responsible for compliance with labor laws in your jurisdiction.
You agree to indemnify and hold harmless Kilbourne.JP, LLC d/b/a JPK Collision Solutions from any claims, damages, or expenses arising from: Your use of the Service, your violation of these Terms, your violation of any third-party rights, and disputes with your employees regarding time records.
We strive for high uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice when possible. We are not liable for downtime due to factors beyond our control.
Kilbourne.JP, LLC d/b/a JPK Collision Solutions shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, government actions, embargoes, labor disputes, failure of third-party hosting or cloud service providers (including Google/Firebase), internet service interruptions, cyberattacks, power outages, or any other event that could not have been reasonably foreseen or prevented.
We reserve the right to: Modify or discontinue features with reasonable notice, update these Terms at any time. Changes become effective upon posting to our website.
You may cancel your subscription at any time. We may terminate accounts for violation of these Terms. Upon termination, your access to the Service will cease. Data retention follows our Privacy Policy (60 days for export).
These Terms shall be governed by the laws of the State of Ohio, without regard to conflict of law principles.
13.1 Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to first contact us at jpk@jpkauto.com and attempt to resolve any dispute informally through discussions with our principals or attorneys.
13.2 Binding Arbitration: Any dispute that cannot be resolved informally within 6 months of initiation shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.
13.3 Location: The arbitration shall take place in Lorain County, Ohio, or at another location mutually agreed upon.
13.4 CLASS ACTION WAIVER: YOU AND KILBOURNE.JP, LLC D/B/A JPK COLLISION SOLUTIONS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
13.5 Small Claims Exception: Either party may bring an individual action in small claims court if the claim so qualifies for such resolution.
13.6 Opt-Out Right: You have the right to opt out of binding arbitration within 30 days of first accepting these Terms by sending written notice.
